I agree the assumption about how proposers interact with transactions they want to censor doesn’t always hold.

In the most recent forward IL proposal, users pay for the IL, by making sure the maxFeePerGas is at least 12.5% (the max amount the base fee can increase from block to block) higher than the current block base fee.

As for the independence from the 30M gas limit, it’s still up for discussion but feels like an implementation detail, to the more important question is Vanilla (block stuffing works as a way to avoid including ILs) vs Forced ILs (Proposer N+1 has to include transactions from the IL no matter what), this was discussed a bit in this post).
